DECLARATION OF SMALL SCALE CHAR AND SMALL SCALE CHARCOAL PLANTS AS CONTROLLED EMITTERS

The Minister of Environmental Affairs has declared, in terms of sections 23(1) of the National Environmental Management Act: Air Quality Act 39 of 2004 ("NEM:AQA"), small-scale char and small-scale charcoal plants as controlled emitters. The Minister further established emission standards in terms of section 24 of the NEM:AQA in order to regulate such plants.

The emission standards differentiate between 'new plants' (i.e. any plant or process where an application for authorisation in terms of the National Environmental Management Act 107 of 1998 ("NEMA") was made on or after 1 April 2010) and 'existing plants' (i.e. any plant or process which was legally authorised to operate before 1 April 2010 or where an application for authorisation in terms of the NEMA was made before 1 April 2010) and makes provision for different compliance timeframes, pertaining to the emission limits as set out in the Notice, for new and existing plants respectively.
